These Terms and Conditions (“T&Cs“) constitute the entire agreement between the Client and VoiceArt for the provision of the coaching services (as defined below). By making a reservation, the Client hereby agrees to be bound by these T&Cs.
VoiceArt, a Dubai based coaching service (hereinafter referred to as “VoiceArt”), provides personalized coaching services. These services include, but are not limited to, vocal/singing coaching, accent reduction, public speaking coaching, acting coaching, and interview preparation, provided by qualified instructors with expertise in their respective fields.
3.1 Initial Inquiry: the Client may initiate a reservation by submitting an inquiry through the VoiceArt website http://voiceart.ae or by contacting a VoiceArt instructor via the WhatsApp link.
3.2 Confirmation: once the inquiry is received, VoiceArt will contact the Client to set up an initial interview and confirm the availability of the desired timeslot. All reservations must be confirmed by VoiceArt. VoiceArt reserves the right to refuse any booking at its sole discretion.
3.3 First interview: an initial interview will be scheduled to discuss the Client’s needs and goals. The first interview will also help VoiceArt assess the required work, and communicate a specific price for the Service to be provided.
3.4 Meeting: the Services offered by VoiceArt will be provided during an online or in-person meeting at the Client’s convenience, subject to the conditions set forth in Clause 7. Unless VoiceArt’s express approval, the Services are provided during Working Hours and on Business Days only.
4.1 Client modifications: The Client may request to modify a reservation up to 24 hours before the scheduled service without any penalty. Modifications requested less than 24 hours in advance may incur additional fees.
5.1 Client’s cancellation: The Client may cancel a reservation up to 24 hours before the scheduled Service. If the reservation is cancelled less than 24 hours in advance, a cancellation fee of 50% of the Service Fee will be charged.
5.2 VoiceArt’s cancellation: VoiceArt reserves the right to cancel a reservation at any time. In such cases, VoiceArt will notify the Client within a reasonable timeframe prior to the agreed reservation and any Service Fee paid will be refunded in full unless VoiceArt and the Client agree to reschedule the meeting.
5.3 No-Show Policy: If the Client fails to attend the scheduled session without prior notification, or cancels less than 2 hours before the session, the full Service Fee will be forfeited.
5.4 Refunds: Refunds for cancelled sessions will be processed according to the cancellation policy stated above. Refunds may take up to ten (10) Business Days to process and will be issued using the method agreed upon by the Parties.
By making a reservation, the Client acknowledges having read, understood, and agreed to these T&Cs. VoiceArt reserves the right to modify these T&Cs at any time. Any subsequent booking of Services by the Client will constitute acceptance of the modified T&Cs.
7.1 VoiceArt offers the following Services:
7.2 The specific details, duration, and scheduling of each Service will be agreed upon between VoiceArt and the Client. All courses will be conducted in English. Group courses are also available upon request and shall be subject to a specific quotation.
7.3 The Services will be provided at a location mutually agreed upon with the Client. The Services may be provided online or in-person. VoiceArt reserves the right to decline a proposed location at its sole discretion and suggest either in-person or online courses if it deems them more efficient for achieving the Client’s objectives or if another method of course is not available at the suggested timeslot. Additional fees may apply for certain locations based on the transportation time and costs.
7.4 The Services shall be provided solely on Business Days and during Working Hours. Should the Client request Services outside of Business Days or Working Hours, VoiceArt may, at its sole discretion, whether to provide such Services. Any Services rendered outside of these standard times shall incur an additional fee, which shall be determined and agreed upon by both Parties prior to the meeting. VoiceArt retains the right to decline any such requests, and any agreement to provide Services outside of Business Days or Working Hours shall not establish a precedent or obligate VoiceArt to approve further similar requests.
8.1 The Client acknowledges that the prices mentioned on the website http://voiceart.ae are indicative. A customized price will be provided after the initial interview.
8.2 VoiceArt reserves the right to modify its pricing at any time. In the event of a general increase, the Client will be informed prior to the next scheduled session.
8.3 The Service Fees shall be paid by the Client in AED via the online payment link provided by VoiceArt. The payment method will be discussed and agreed upon the Parties.
8.4 In the event of late payment or failure to pay the Service Fees, VoiceArt shall be entitled to impose a ten percent (10%) late payment penalty on the outstanding Service Fee, with an additional five percent (5%) monthly penalty accruing every thirty (30) days.
9.1 The Client agrees to provide accurate and truthful information when making a reservation and to promptly notify VoiceArt of any changes, in particular regarding contact information.
9.2 The Client agrees to comply with the instructions and guidance provided by VoiceArt during the coaching sessions.
9.3 The Client hereby agrees to notify VoiceArt of any cancellations or rescheduling at least 24 hours in advance to avoid cancellation fees.
9.4 The Client agrees to pay the Service Fee which shall be communicated by VoiceArt prior to the provision of Service.
10.1 VoiceArt will use its best efforts to provide coaching Services in accordance with the Client’s needs and objectives as determined during the initial consultation outlined in Clause 3.3.
10.2 VoiceArt will provide qualified and skilled professionals with expertise in their respective fields.
10.3 VoiceArt will endeavor to inform the Client prior to any changes to reservations or cancellations.
Each Party retains all copyright, database rights, trademarks, and all other intellectual property rights of any nature in any country of the world at all times and for all purposes. The Client is not granted any rights in any material, deliverable, document, or intellectual property provided by VoiceArt, except the right to use such materials for the purpose of receiving the Services. All content provided during sessions, including but not limited to course materials, exercises, and feedback, are the intellectual property of VoiceArt and shall not be reproduced or distributed without VoiceArt’s prior written consent.
VoiceArt understands the importance of maintaining the confidentiality of the Client’s relationship with VoiceArt and will take the utmost care to preserve its confidentiality and the confidentiality of any documents provided by the Client. VoiceArt will handle the Client’s personal data in accordance with applicable data protection laws and regulations. Personal data will be used solely for the purpose of providing the Services and will not be shared with third parties without the Client’s consent, except if required by law. VoiceArt may use the Client’s personal data to contact the Client for the purpose of providing the Services and for commercial purpose after a period of inactivity. The Client has the right to access, correct, or request the deletion of their personal data by contacting VoiceArt.
No Party to these T&Cs shall be liable for any failure to fulfil its obligations hereunder apart from obligations to make payments of the Service Fee, where such failure is caused by circumstances outside the reasonable control of such Party, including, without limitation, any natural disaster, insurrection or civil disorder, war or military operations, national or local emergency, public health event or pandemic, acts or omissions of Government including directives, fire, lightning, explosion or any other such cause (each a “Force Majeure Event”). All Parties agree that any of the events mentioned in this Clause shall qualify as a Force Majeure Event only where the Force Majeure Event cannot be resolved through the exercise of a Party’s reasonable effort or expenditure and the Force Majeure Event is an unforeseeable event. The Party affected by the Force Majeure Event shall take all reasonable steps to mitigate the effect of the Force Majeure Event and promptly notify the other Party as soon as it is practicable of the estimated extent and duration of such inability to perform its obligations. The Parties shall in good faith decide on measures to be taken to try and mitigate the resulting consequences (such as adopting online coaching Services) as well as the conditions for the resumption of the Services after the suspension or termination of the Force Majeure Event.
VoiceArt will take reasonable measures to provide the Services professionally and competently. However, the Client understands and accepts that due to the nature of the Services provided, individual progress may vary. Consequently, VoiceArt shall not have any obligation of result and shall not be liable for any advice provided or the suitability of the Service to a specific purpose. VoiceArt shall not be liable for any injuries, damages, or losses incurred during or as a result of the Service. Clients participate at their own risk. VoiceArt shall not be liable for any indirect, incidental, or consequential damages arising from the Services provided. The maximum liability of VoiceArt for any and all claims arising out of the provision of the Services will be limited to the amount paid by the Client for the specific Service during the thirty (30) days preceding the damage.
These T&Cs are governed by and construed in accordance with the laws of Dubai. The Parties shall in good faith and using reasonable efforts attempt to settle, amicably through negotiation and discussion, any dispute arising out of or in connection with these T&Cs. All disputes remaining unresolved by negotiation between the Parties shall be referred to and finally resolved by binding arbitration in accordance with the arbitration rules of the International Chamber of Commerce, which ICC rules are deemed incorporated by reference in this Clause. The arbitration shall be conducted by one (1) arbitrator appointed in accordance with the ICC Rules. The seat of the arbitration shall be in Dubai, UAE, and the language of the arbitration shall be English.
No delay or failure on the part of any Party to exercise or enforce any right given to it by these T&Cs or by law, nor any custom or practice of any Party at variance with the terms of these T&Cs, shall constitute a waiver of the rights of any Party under these T&Cs, nor shall it operate to prevent the exercise or enforcement of any such right at any time.
If any provision of these T&Cs is held to be invalid or unenforceable, in whole or in part, that provision or part thereof shall to that extent be deemed not to form part of these T&Cs. However, the validity and enforceability of the remainder of these T&Cs shall not be affected.
The Client shall not transfer, subcontract, nor assign its obligations under these T&Cs without the prior written consent of VoiceArt.
These T&Cs constitute the entire agreement between the Parties concerning the provision of the Services and supersede all prior oral or written agreements. These T&Cs may be amended by VoiceArt within the conditions set out in Clause 6.
